New York Wrong-Site Surgery: Preventable Harm

Surgery is stressful enough without having to worry whether the surgeon is going to operate on the correct body part. A wrong-site surgery occurs when the doctor mistakenly performs a medical procedure on the incorrect organ or wrong side of the body.

Although some of these sorts of medical mistakes may be corrected after the fact, they are often irreversible, such as with an amputation or removal of an internal organ.

Recent New England Example

The Rhode Island Department of Health on November 2 publicly reprimanded Providence’s Rhode Island Hospital, affiliated with Brown University, for an October surgery on a patient’s wrong finger. The Health Department found that the hospital did not follow its own safety procedures governing proper surgical-site marking and planned timeout from the surgical process to check that nothing was amiss.

For only the second time ever, the Rhode Island Department of Health imposed a fine on a hospital (0,000). The first was on the same institution in 2007 for another wrong-site surgery. In addition to the current incident, this hospital has had four other wrong-site surgeries since 2006: three brain surgeries and one for cleft palate.

In addition to the fine, regulators required the hospital to install video and audio equipment in operating rooms and mandated observation for a year of each surgical procedure by a medical professional with special training in safe surgery and implementation of a statewide surgical safety protocol that was developed by the World Health Organization (WHO).

Hospital President and Chief Executive Officer Timothy Babineau, M.D., acknowledges the most recent incident on the hospital’s Web site, pledging ongoing safety improvement. He estimates that “wrong site surgical errors continue to occur at hospitals all over this country at a rate of nearly 40 per week.”

Root Causes and Prevention

Researchers have found wrong-site surgeries to be symptomatic of both poor communication among involved medical professionals, the patient and family and of inadequate teamwork among the doctors, nurses and other medical professionals on the surgical team. Other contributing factors include fatigue, stress, complexity of our healthcare system, inadequate institutional information management systems, hurriedness and inexperience.

WHO developed an international pilot program that introduced a Surgical Patient Safety Checklist and found that when followed, use of the protocol resulted in nearly one third significantly fewer deaths and complications among a diverse adult patient population undergoing non-cardiac surgery. The pilot program researchers, who are part of the WHO Safe Surgery Saves Lives Study Group, published their findings in the January 14, 2009 edition of the New England Journal of Medicine.

Essentially, the WHO protocol has evolved into a 19-item checklist that contains a series of points during all surgical procedures that a surgical team goes through and when doing so, the team must confirm they had completed each step in the protocol. For example, the study identified three critical points during a surgical procedure: before anesthesia, just before incision, and before the patient leaves the operating room.� A significant requirement of this protocol is that a member of the team must verbally confirm that each step of infection control, anesthesia safety and other important considerations�are met, such as confirming the correct surgical site is marked at the start and at the time the surgery begins, or the right number of sponges and instruments are on the table and of course, at the end of the procedure.�

In addition to WHO, the Joint Commission on Accreditation of Healthcare Organizations (JCAHO or Joint Commission), the biggest and oldest U.S. professional organization setting healthcare safety standards and accrediting medical facilities, has developed, with input from major medical associations, professionals and the public, the Universal Protocol for Preventing Wrong Site, Wrong Procedure and Wrong Person Surgery (Universal Protocol). Widely endorsed, the protocol has three main parts:

Presurgury verification of documents
Clear and unambiguous surgical-site marking
Timeout immediately before surgery

The timeout is used to confirm the right surgical procedure, surgical site and patient identity. All members of the surgical team are urged to verbalize during the timeout questions or confusion about the surgery the team is about to perform.

The jury is still out as to the long-term effectiveness of the Universal Protocol in preventing surgical-site errors. Its use is required in JCAHO-accredited facilities and its basic elements have been adopted and enhanced by many state governments, professional organizations and medical institutions in developing their own protocols.

New York Surgical Errors

The problem of wrong-site surgery is also alive and well in New York. For example, from 2003 to 2005, 347 wrong-site, wrong-patient or wrong-procedure events were reported through the New York Patient Occurrence and Tracking System (NYPORTS), the mandatory state medical-error reporting system.

After reviewing the Universal Protocol and other resources, New York developed its own New York State Surgical and Invasive Procedure Protocol (NYSSIPP). NYSSIPP is the official and required standard of care for most surgical procedures in New York. It includes and enhances the three basic elements of the Universal Protocol — verification, marking and timeout — plus standards for scheduling, consent, disagreement resolution and compliance oversight. NYSSIPP especially encourages active communication among all members of the surgical team, particularly during the scheduled preoperative timeout.

New York Medical Malpractice

A New York patient who is the unfortunate victim of wrong-site surgery should consult with an experienced medical malpractice attorney to discuss possible legal remedies. In order to be successful on a claim for medical malpractice in New York, a plaintiff must prove that the doctor or other medical professional departed from an accepted standard of practice, and that the deviation proximately caused the complained-of injury. Other possible legal claims could be general negligence, gross negligence, wrongful death, lack of consent or reckless indifference. In a New York wrong-site surgery case, a likely issue will be whether the surgeon and his or her team complied with the requirements of the Universal Protocol and the NYSSIPP, and whether deviation from the standards in those protocols caused injury.

It is not every day that you get to hear that a surgical procedure has gone well for a football player, especially when that football player happens to have an injury which destabilizes a patella ligament in his left knee. Such was the case of Mark Sanchez who is a Mexican-American football quarterback who was drafted in the first round of the 2009 NFL draft and started his career by playing college football at the University of Southern California (USC) and at the same time then just became the fourth rookie quarterback to ever win his first playoff game in the NFL history so this player has had quite a few achievements which might’ve gone sour if his knee operation wasn’t a complete success.

The procedure was described to be a minimally invasive “partially arthroscopic” ligament repair and even though those sound like big words especially for someone whose career depends on the success of such procedure, everything went perfectly.  This quarterback is expected to fully recover by July of this year at which point he will be once again training with the team.

A few days before the Super Bowl Sanchez said that he would definitely be ready for camp and that he would also try to participate in as many organized team activities as his condition allowed him.

Jets quarterback Mark Sanchez has not only been in the spotlight due to his sports related achievements but also because of the fact that he is put himself in several situations where the media has been able to spin his flirtatious relationship with “The Hills” star Kristin Cavallari at a Maxim bash earlier in 2010. But whatever the situation may be I am pretty sure that Jets fans will keep a close eye on this photogenic quarterback as he recovers from his injuries and will hope for the best during camp activities.

At the same time the Jets also signed Nick folk for a one-year deal. Nick folk is a former Dallas Cowboys kicker who had choice of either going with the Jets or Giants but this time around he opted for the Jets deal as it seemed a lot more convenient for him.

Due to the fact that the price of some kickers keeps going up the Jets had to sign Nick folk for that one year deal, while keeping in mind that Jay Feeley is scheduled to become an unrestricted free agent. During the last season Feely made 30 of 36 field goal attempts and he also scored 122 points while on the other hand, Folk made 18 of the 28 field goals attempts and scored only 90 points in 14 games and it was assumed such performance was the reason why the Cowboys excelled with two weeks remaining in that particular season.

Based in the New York metropolitan area, The New York Jets are a professional American football team. They are members of the Eastern Division of the American Football Conference (AFC) in the National Football League (NFL). They play their home games in East Rutherford, New Jersey at Giants Stadium, named after another NFL team, the New York Giants. The Jets officially refer to the venue as “The Meadowlands,” a name used on all official NFL and team game notes regarding Jets’ home games.

The club’s headquarters are located at Hofstra University in Hempstead, New York on Long Island. They are constructing a new training facility and corporate headquarters in Florham Park, New Jersey.

The jets began in 1960 as a deed member of the American Football League under the name New York Titans. Renamed after Sonny Werblin bought the team in 1963, it later joined the NFL as part of the AFL-NFL Merger.

The Jets hold the characteristic of being the first AFL team to defeat an NFL club in an AFL-NFL World Championship Game when they crushed the Baltimore Colts in Super Bowl III.

Franchise history
Originally known as the New York Titans, the team played home games at the Polo Grounds. After a 5 to 9 season in 1962, the team’s future was in doubt. A group headed by MCA head Sonny Werblin and Leon Hess, bought the team from Harry Wismer on March 13, 1964, saved it from ruin. Hess eventually bought out his partners, and kept sole ownership until his death. His estate then sold the team to Johnson & Johnson heir Robert Wood Johnson IV in 2000.

After they took over, the team was renamed the New York Jets to transfer from the Polo Grounds to the New York Mets’ Shea Stadium one year later. Shea Stadium lies so close to LaGuardia Airport that the sound of jets roaring overhead was a common sound heard during games played there. The team’s colors were also changed from blue and gold to kelly green and white, which also were the colors of Hess’ gasoline stations.

Exactly one month after the sale of the team, the Jets hired Weeb Ewbank as head coach. He had won back-to-back NFL championships in 1958 and 1959 with the Baltimore Colts, and was one of the most respected coaches in the game.

2005
The 2005 season started out with the Jets reacquiring WR Laveranues Coles from the Washington Redskins and getting CB Ty Law from the New England Patriots. They also acquired free agent quarterback Jay Fiedler of the Miami Dolphins as an expert backup for the starter, Chad Pennington. During the Draft, the Jets traded their first round selection for Raider’s Tight End Doug Jolley. The Jets used their first selection (2nd round, 15th pick) to select Ohio State Kicker Mike Nugent to replace the departed Doug Brien. The Jets allowed several key role players to leave through free agency or traded them for underachieving players. These players included LaMont Jordan, Kareem McKenzie, Sam Cowart, Jason Ferguson, and to a lesser extent Anthony Becht.

The Jets entered the season with high hopes of competing for the Super Bowl, but in week three against the Jaguars when Chad Pennington reinjured his shoulder. Their backup quarterback Jay Fiedler was injured six plays after Pennington. The injuries caused previous third-string quarterback Brooks Bollinger to take the role as the team’s starter and Vinny Testaverde was brought back out of retirement as Bollinger’s backup. After a poor showing by the Jets’ offense in a loss, Testaverde would start the Week 5 game against the Tampa Bay Buccaneers. His steady hand led the offense, and Curtis Martin scored two touchdowns, giving the Jets just enough to earn a 14 to 12 victories over the earlier unbeatable Buccaneers.

2006
On January 17, the Jets-Patriots coaching pipeline reared itself yet again, as New England defensive coordinator Eric Mangini was hired by the Jets and became the youngest head coach in all 4 major American sports, turning 35 on January 19. Mangini’s first order of business was to reorganize the coaching staff. Offensive Coordinator Mike Heimerdinger and Defensive Coordinator Donnie Henderson were both released from the Jets staff. Special Teams Coordinator Mike Westhoff was retained. A full staff was announced on February 20. Linebackers coach Bob Sutton was named defensive coordinator and the team signed Jim Herrmann to replace Sutton as the linebackers coach. He was the defensive coordinator at the University of Michigan for twenty years before arriving in New York. Eric Mangini then installed a 3-4 defense.

General Manager Terry Bradway announced that he was stepping down as Jets GM on February 7, 2006. Assistant GM Mike Tannenbaum was named the new GM on the same day. Bradway continue to be employed as an investigation consultant.

The Jets finished the regular season with a record of 10-6, having defeated the Minnesota Vikings, Miami Dolphins, and the Oakland Raiders in their last three games. They earned the 5th AFC Wild Card spot in the playoffs.
